1. Who we are
This Privacy Policy applies to Awareness Connect Pty Ltd (ABN 95 672 195 783) trading as Awareness Connect Enterprises (ACE, we, us, our). It explains how we collect, use, disclose and protect personal information through awareness-ace.com, our forms, emails and calls, and our property research and sourcing service. We handle personal information in line with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth).
2. Our role
All properties identified by ACE are discussed with our licensed buyer’s agent partners. ACE provides research and general information only. ACE does not negotiate, represent buyers, handle funds, bid, sign on a client’s behalf or conduct licensed real estate agency work.
ACE is not a licensed real estate agent or buyer’s agent, and we do not collect personal information for the purpose of carrying out any of that work.
3. What we collect
Depending on how you deal with us, we may collect:
your name, email address, phone number and the state or region you live in;
your property requirements, such as the type of property, preferred locations, budget range, timeframe and any other preferences you choose to tell us;
notes from discovery calls and other calls with us;
payment and billing details (card details are collected and processed by our payment provider, Stripe, and we do not store full card numbers);
your marketing preferences and records of your consents;
website usage information collected through cookies and similar technologies (see section 9).
Please do not give us detailed financial information, such as bank statements or superannuation details. We do not need it to provide our research service.
You can deal with us anonymously or using a pseudonym for general enquiries. However, we need your name and contact details to respond to you and to provide our service.
4. How we collect it
We collect personal information directly from you when you fill in a form on our website, book or attend a call, email or message us, buy our service, or subscribe to our emails. We also collect some information automatically when you use our website (see section 9).
5. Why we collect, use and hold it
We use personal information to:
respond to your enquiry and book discovery calls;
prepare and deliver your property research;
discuss the properties we identify, and share your details and requirements, with our licensed buyer’s agent partner in the relevant state as part of service delivery (see section 6);
process payments, issue tax invoices and handle refunds;
send you service messages and, if you have agreed, marketing emails;
improve our website and services;
meet our legal obligations and deal with complaints or disputes.
6. Sharing your information with our licensed buyer’s agent partners
All properties identified by ACE are discussed with our licensed buyer’s agent partners. These discussions are held personally by ACE’s founder. As part of delivering our service, we share your personal information and your property requirements with our licensed buyer’s agent partner in the relevant state. This may include your name, contact details, your brief (property type, locations, budget range, timeframe and preferences) and the properties we have identified for you. We do this so the partner can review the properties and, if you choose, contact you about their licensed buyer’s agent services.
Each partner is an independent, licensed business. Once a partner receives your information, it handles that information under its own privacy policy.
Our written arrangements with partners require them to use your information only for these purposes, keep it secure, not sell or on-share it, and tell us promptly about any data breach.
You are not obliged to engage any partner. If you choose to engage one, you do so under a separate agreement directly with them.
We ask for your agreement to this sharing when you engage us. If you do not want your information shared with a partner, tell us before we start work. We may then be unable to provide the full service, and we will discuss a refund under our Refund and Cancellation Policy.
You can withdraw your agreement at any time by emailing ace-admin@awareness-ace.com. We will stop any further sharing and ask the partner to stop using your information for our purposes. Withdrawal does not affect information a partner holds because you have engaged them directly.
ACE will disclose any fee or benefit in writing before an introduction.
We do not sell personal information.
Details of the partners we work with are listed on our Trusted Partners page at awareness-ace.com/trusted-partners/.
7. Other disclosures
We may also disclose personal information to:
service providers who help us run our business, including our website host (Hostinger), our website form provider (WPForms), our payment provider (Stripe), Google (for website analytics through Google Analytics and Google Site Kit, and for spam protection through Google reCAPTCHA), and our email, calendar and booking providers;
our professional advisers, such as our accountant or lawyer;
anyone you ask us to share it with;
government agencies or others where required or authorised by law.
8. Overseas disclosure
Some of our service providers, including Google and Stripe, may store or process personal information outside Australia, including in the United States and other countries where those providers or their data centres operate. We take reasonable steps to make sure overseas recipients handle personal information consistently with the APPs.
9. Cookies, analytics and reCAPTCHA
Our website uses:
essential cookies that make the site and its forms work;
Google Analytics, through Google Site Kit, which uses cookies (such as _ga) to tell us how visitors use the site, including pages viewed, approximate location, device and browser. We use this information in aggregate to improve the website;
Google reCAPTCHA on our forms, which collects hardware and software information, such as device and browser data, and sends it to Google to check that form submissions come from people rather than automated programs. Google’s Privacy Policy and Terms of Service apply to that use.
We do not use advertising or social media tracking pixels on this website. You can block or delete cookies through your browser settings, and you can opt out of Google Analytics using the Google Analytics Opt-out Browser Add-on. Blocking essential cookies may stop parts of the site, including forms, from working.
10. Direct marketing
We send marketing emails only if you have agreed to receive them. Every marketing email identifies ACE, includes our contact details and includes a working unsubscribe link. We act on unsubscribe requests within 5 business days. We do not give your information to partners or anyone else for their own marketing.
11. Security and retention
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls and the use of reputable service providers. We keep personal information only for as long as we need it for the purposes in this policy or as required by law (for example, we keep tax records for 5 years), and then delete or de-identify it.
12. Access and correction
You can ask to access or correct the personal information we hold about you by contacting us (see section 14). We will respond within a reasonable time, usually within 30 days. If we refuse your request, we will tell you why and how you can complain.
13. Complaints
If you have a privacy complaint, please contact us first. We will acknowledge it within 5 business days and aim to resolve it within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
