1. About these terms
These Terms of Service apply when you use awareness-ace.com or buy a service from Awareness Connect Pty Ltd (ABN 95 672 195 783) trading as Awareness Connect Enterprises (ACE, we, us, our). By accepting these terms at checkout, paying for our service or otherwise engaging us, you agree to these terms.
2. Our service
ACE provides independent property research and sourcing based on the brief you give us (the Service). The Service includes a written research report covering the matters described on our website at the time you buy, which may include a summary of your brief, a shortlist of suitable areas with the reasons for each, key data with sources and dates, a list of matters to check, examples of currently listed properties that match your brief, and details of our licensed buyer’s agent partner in the relevant state.
We will deliver your report within 10 business days of receiving your completed brief, unless we agree a different timeframe with you in writing. We will tell you promptly if we expect a delay.
3. What ACE does not do
All properties identified by ACE are discussed with our licensed buyer’s agent partners. ACE provides research and general information only. ACE does not negotiate, represent buyers, handle funds, bid, sign on a client’s behalf or conduct licensed real estate agency work.
ACE is not a licensed real estate agent or buyer’s agent in any state or territory. ACE does not perform any function that requires a licence under the Property and Stock Agents Act 2002 (NSW) or any equivalent law of another state or territory. Any such function may only be performed by a licensed buyer’s agent you engage directly under a separate written agreement, and ACE is not a party to that agreement.
ACE does not provide financial product advice, SMSF or superannuation advice, credit assistance, tax advice or legal advice, and nothing we provide is a recommendation to buy any particular property. You should get independent advice from appropriately licensed professionals before making any decision.
4. Licensed buyer’s agent partners
ACE’s founder personally discusses the properties ACE identifies with our licensed buyer’s agent partners. Our partners are independent businesses that hold their own licences. If you engage a partner, you do so under a separate written agreement directly with them, on their own fees and terms, and they are solely responsible for the licensed services they provide.
You are free to engage any agent, or none. ACE will disclose any fee or benefit in writing before an introduction.
5. Fees and payment
The fee for our standard property research and sourcing service is $495 including GST ($450 plus $45 GST), payable upfront when you engage us. If a different fee is shown on our website for a particular service at the time you buy, that fee applies.
The fee is for the research service only.
The fee is fixed. It does not depend on whether you buy a property or engage any agent, it is not calculated by reference to any property price or agent’s fee, and it is not a commission.
We will issue you a tax invoice.
Payments are processed by Stripe. Buy-now-pay-later options, where offered, are provided by third parties on their own terms.
6. Your information and partner sharing
You agree that, as part of delivering the Service, we will share your name, contact details and property requirements, and the properties we identify, with our licensed buyer’s agent partner in the relevant state, as described in our Privacy Policy (awareness-ace.com/privacy-policy/). If you do not agree to this, please tell us before we start work. We handle all personal information in accordance with our Privacy Policy.
7. Your choices and responsibilities
You agree to give us accurate information about your brief and to tell us about any changes. Our research relies on the information you give us. You decide whether to buy any property and whether to engage any professional. Before acting, you should get independent advice from appropriately licensed professionals and carry out your own due diligence, including building, pest, strata, title, zoning, finance and legal checks.
8. Nature of our research
Our reports are general information based on data available when they are prepared, including third-party and publicly available data that we believe to be reliable but do not independently verify. Property markets change. Past performance is not a reliable indicator of future performance, and property values and rents can fall as well as rise.
We do not promise or guarantee any price, rent, return, capital growth, income or other outcome, or that any property will be available or will be bought. Example listings are illustrations, not recommendations to buy.
9. Cancellation and refunds
Our Refund and Cancellation Policy (awareness-ace.com/refund-policy/) forms part of these terms. In summary, you will receive a full refund if you cancel before we start work, and $150 is retained if you cancel once work has started but before your report is delivered.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they will be provided with due care and skill, will be reasonably fit for any purpose you make known to us, and will be supplied within a reasonable time. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
11. Liability
To the extent permitted by law, and subject to clause 10, ACE is not liable for any loss arising from decisions you make about buying property, finance or investment, from the acts or omissions of any partner or other third party, or from information supplied by you or by third-party data sources. Where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
12. Intellectual property
We own the copyright in our reports and website content. You may use your report for your own personal purposes and share it with your own advisers, but you must not publish or resell it without our written permission.
13. Complaints
Please contact us first at ace-admin@awareness-ace.com or on 0411 584 706. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days. You can also contact NSW Fair Trading.
14. Governing law
These terms are governed by the laws of New South Wales, Australia.
15. Changes to these terms
We may update these terms for future purchases. The terms in force when you paid for the Service apply to your purchase.
